Okay I have one for you, does a swashbuckler fight toe to toe to the
death.... My DM sayd I cant leave my party, but If I cant retreat then
what is the use of me using a swashbuckler? Your thoughts?

I have only a vague idea of what you're talking about, but ultimately,
YOU must control the actions of your characcter.

Yeah, the DM should only step in to remind you what your charachter's
class usually does. If your Swashbuckler is a whimp (or is having a
whimpy day) then let him run. If he is feeling especially brave and
daring (and I mean VERY brave and daing, above the normal swashbucker
daring or just feeling stupid) then have him stand fighting until he has
    only 1 hp.

As I was saying in the Racial limits about not always sticking to class
rules, a bit of unexpected variety keeps it interesting.
